VS Tennis Academy LLC Participant Contract, Liability Waiver, Photo Release Agreement, and Medical Release Form

Applicable to the State of Florida

This contract ("Agreement") is made effective as of the date of signing or purchase, by and between VS Tennis Academy LLC ("Academy") and the individual and/or their minor child(ren) ("Participant"). By making a purchase of services from the Academy, the Participant agrees to the terms and conditions as set forth below, which comply with the laws of the State of Florida.

1. Participant Information

This Agreement applies to the Participant and their minor child(ren) if applicable.

2. Services Provided

VS Tennis Academy LLC offers professional tennis lessons, camps, and training sessions for individuals of all ages and skill levels. Services may include group lessons, private lessons, tennis clinics, and other tennis-related programs.

3. Terms of Service

Single Session Purchases: Participants purchasing individual tennis lessons or training sessions must complete the session within 30 days of the purchase date.
Packages or Plans: Participants purchasing lesson packages or plans (e.g., multiple sessions) must use all sessions within 30 days from the date of purchase. Unused sessions after this 30-day period will expire and will not be refunded or carried over.
Rescheduling Policy: Participants may reschedule a lesson or session at least 24 hours in advance. Cancellations or rescheduling requests made with less than 24 hours' notice for private lessons will result in the forfeiture of that session without refund. This non-refundable policy applies to all private lessons canceled within 24 hours of the scheduled time.

4. Agreement to Terms by Purchase

By making a purchase from VS Tennis Academy LLC, whether online, in-person, or through any other method, the Participant acknowledges that they have read, understood, and agreed to all terms and conditions outlined in this Agreement. This Agreement constitutes a binding legal contract, enforceable under Florida law.

5. Waiver of Liability (Applicable to Florida Law)

5.1 Assumption of Risk

By making a purchase, the Participant acknowledges and agrees that participation in tennis lessons, training, or any activities provided by VS Tennis Academy LLC involves inherent risks, including physical injury, illness, or death. The Participant voluntarily assumes all such risks and hazards, whether caused by negligence or otherwise, in connection with participation in Academy activities.

5.2 Waiver of Liability

To the fullest extent permitted by Florida law, the Participant releases, waives, discharges, and holds harmless VS Tennis Academy LLC, its owners, employees, instructors, agents, affiliates, and representatives from any and all liability, claims, demands, actions, or causes of action for any injury, accident, illness, death, or other damages that may arise from participation in Academy activities, whether caused by negligence or otherwise, except in cases of gross negligence or intentional misconduct.

5.3 Acknowledgment of Risks Involving Minors

The Participant acknowledges that Florida law may provide certain protections for minors in sporting activities. While this waiver is intended to release VS Tennis Academy LLC from ordinary negligence, the Participant understands that it may not extend to claims from gross negligence or willful misconduct, especially regarding minor children.

6. Medical Release Form and Authorization

By making a purchase, the Participant authorizes VS Tennis Academy LLC to take the following actions in the event of a medical emergency:

Authorization for Emergency Medical Treatment: The Participant authorizes VS Tennis Academy LLC to seek medical treatment, including first aid, ambulance transport, and emergency medical services on behalf of the Participant or minor child(ren).
Release of Medical Information: The Participant authorizes medical professionals involved in the emergency treatment to release relevant medical information to VS Tennis Academy LLC.
Consent for Treatment: The Participant acknowledges they are responsible for all medical costs incurred as a result of emergency medical treatment. VS Tennis Academy LLC shall not be liable for any medical costs or for decisions made during emergency care.

7. Photo and Video Release

The Participant grants VS Tennis Academy LLC permission to take photographs and video recordings of the Participant and/or their minor child(ren) during Academy activities for promotional and marketing purposes, including social media, website content, advertisements, and printed materials.

Opt-Out: If the Participant does not wish to be included in any photographs or videos, they must notify VS Tennis Academy LLC in writing.

8. Code of Conduct

Participants and their children are expected to conduct themselves with respect, sportsmanship, and consideration for others. The Academy reserves the right to remove any individual from a session or program for inappropriate behavior, with no refund for unused sessions.

9. Refund Policy

No refunds will be issued for unused or expired sessions. In exceptional circumstances, such as medical emergencies, refunds or credits may be considered at the sole discretion of VS Tennis Academy LLC.

10. Florida Consumer Protection Laws

This contract is subject to Florida consumer protection laws. Provisions related to non-refundable services, cancellations, or rescheduling comply with applicable Florida statutes, including the Florida Deceptive and Unfair Trade Practices Act (FDUTPA).

11. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Florida.

12. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior understandings with respect to the subject matter herein.

13. Severability

If any provision of this Agreement is found to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

14. Acknowledgment

By making a purchase, the Participant acknowledges that they have read, understood, and agreed to all terms and conditions outlined in this Agreement, including the liability waiver, medical release form, emergency authorization, and photo release.
